All promotional CD compilations produced by ERG Music in Canada are
licensed by the participating record labels through the Audio Video Licensing
Agency Inc. (AVLA) on the conditions that they are acquired on a Leased
basis only and are not sold. The license agreement with AVLA further
requires that these programs are distributed only to commercial users
and are not available to the general public. You are required to confirm
eligibility prior to acquiring these CDs programs. In addition, purchasers
forfeit any right of resale and must further agree that any sound recordings
provided to them will not be duplicated in any way.
If you qualify as an authorized user and wish to acquire ERG Music promotional
CD compilations, you must read and agree to the terms and conditions
as follows:
I agree that as a subscriber and lessee of ERG Music, I am subject to
the terms and conditions of the agreement between AVLA and ERG Music,
including but not limited to the following:

Recorded music compositions embodied on digital programs leased
from ERG Music are not to be duplicated, sold, or otherwise distributed. |

Where indicated, the copyright in the recorded music compositions
embodied on digital programs leased from ERG Music are the property
of the AVLA record companies. |

| 3. |
All lease agreements for digital programs with ERG Music are subject
to, and terminate upon the termination of the AVLA/ERG Music licensing
agreement. All ERG Music digital programs must be returned to ERG
Music upon written notice of termination. |

| 4. |
The lessee understands that this acknowledgement applies to all
digital programs acquired from ERG Music. |

| 5. |
I understand that Entertainment Resources Group (ERG Music) CD
compilations are licensed only for promotional use by commercial
users and that any other use including unauthorized resale, distribution,
public display, duplication, violation of applicable laws, including
federal copyright laws, or any other unauthorized use, is strictly
prohibited. Purchasers violating these conditions will be subject
to any legal actions resulting from such misuse, including but not
limited to, criminal prosecution. |

All respective copyrights in the sound recordings and musical works
embodied on ERG Music CDs are the property of participating artists,
composers, authors, publishers and record labels as applicable. |
