All promotional CD compilations produced by ERG Music are licensed by the participating record labels on the condition that they are sold and/or distributed only to Broadcasters, Professional DJs, or Public Performance Venues such as Nightclubs, Bowling Centers, Roller Rinks, etc. Purchasers are required to confirm eligibility prior to purchasing these CDs. In addition, purchasers must agree to forfeit any right of resale and must further agree that any sound recordings provided to them will not be duplicated in any way.

I understand that Entertainment Resources Group (ERG Music) CD compilations are licensed only for promotional use by professional DJs and that any other use including unauthorized resale, distribution, public display, duplication, violation of applicable laws, including federal copyright laws, or any other unauthorized use, is strictly prohibited. Purchasers violating these conditions will be subject to any legal actions resulting from such misuse, including but not limited to, criminal prosecution. All respective copyrights in the sound recordings and musical works embodied on ERG Music CDs are the property of participating artists, composers, authors, publishers and record labels as applicable.

I hereby certify that I am A) currently employed as a Radio Program Director, Music Director or B) purchasing these CDs on behalf of and for use by/in a licensed broadcaster. I further certify that all CD programs acquired will be used only in my/our business. I further acknowledge and agree that all music programs are acquired on the basis that they are not to be resold, exchanged or traded in any way and that any and all applicable ASCAP, BMI, SESAC or other related licenses or fees are not the responsibility of ERG Music.
